Can I sue the Groomer?

I do not now what to do! My Shih-tzu . She went to the groomer and I ended up at the vet and he told me that:the groomer had cut her tummy and left all kinds of hair in her eyes.What can I do about the groomer. The Vet said he pulled all kinds of hair out of her eyes, and had to sow up her tummy, the blade cut her. I have always used this groomer on my toy poodles and never happen. Can I sue the groomer? The Groomer did not offer any kind of comtrack before she started grooming, Infact She did not even tell me anything about my pup being hurt. I was taking my pup out and looked down and seen blood! She closed behind me and when i seen the blood I tured to go back inside she would not let me in. This is form the akc club refences, they told me that this groomer was the best in my town.
I forgot to say that, I have tried all day to get back intouch with them, just to find out what happen.I time I got hold of her husband, and he said " WE did not do that It was done already" The sad thing is I took photos before I took her, becouse it was only her 2ed time at the groomers! and it was her 1st full groom. VET said she has had 5 dogs come up there with aobut the same thing wrong from that groomer. THE VET has put up a sign that expains everthing that has happen so hoppfully no one has to go though that again. My mom told me to call the ASPCA Wonder if they could do anything. I just do not want them to be inbuisness any more, I though I could get a judge to shut them down that is why I was thanking about sueing. Becouse it was not the $78.95 it was the fact that she got hurt and some other little pup could get hurt!
Thank you all for all the input. Suzanna lynn is in the vets, she lost a lot of blood and she only weights 3 pounds anyways. so they are giveing her blood.

I tried to call they will not talk to me, This groomer was my friend, we just had a BQ I have been going to her for 8 years. We have never had a problem. I have been to her house and she would not come to the door, infact she sent he 11 yr old son out and told me that I was a b**ch and She wished I was died. I have never said a cross word to her. We go to the same church. I knew she was having personal problems, but she said it was her Son at work.

I can not bleive this. I am so upset i can not even type. I am so sorry for this.

SUE SUE SUE SUE SUE, You should SUE there pants off!! I would never go back there. Also you need to in form the AKC Club that did that and tell them about what happen.

    She probably didnt tell you your puppy got hurt to be safe. but definitely SUE! your puppy must have been in much stress. I really hope your dog gets better, email me when she heals up!

    yikes that is a horrible a story! personally i'm not sure i'd go the 'suing' route… that takes a lot of time and money and i'm not sure you'd win, even though what the groomer did was wrong. i would just send them a letter or call them and let them now how disgusted you are with their service and what your dog had to indure as a result! i would also contact the akc and let them know of your experience so they don't refer that place again. also, find a new groomer :P

    Not only should you sue, but you need to let all of your friends and family know. Bad news spreads like wildfire. Your vet should also post on the bulletin board in their clinic to let other pet owners know not to take their animals to that groomer. Maybe it's over the top, but I would also send a letter to the BBB with a copy of the vet bills and vet statements that prove the groomer did this to your dog.

    Yes, you can sue. Keep your vet records and records that you paid for the grooming. Take photos of the damage. Take all that stuff and take her to small claims court. Show the judge all your evidence and demand monetary damages. Usually, dogs are considered "property" in courts and so if someone hurts them, they are liable. Your groomer was really nasty to do this to your dog and not even tell you. She obviously hurt your dog really bad.

    yes you should sue them. especially after she did not let you back in the groomers. that is animal abuse. she knew that she hurt the dog she did not want to take the dog to the vet because she did not want you to find out, but you found out about it anyway. so yes SUE SUE SUE

    If that's the best, I'd hate to see any of the others! Don't bother to sue the groomer. There are too many such lawsuits out there as it stands. Don't add to them. First, go to the groomer or phone her and speak to her. Ask as calmly and politely as you can what happened and why. Do your best not to give her any reason to become defensive. Treat her as you'd like to be treated in her stead.

    You're right: this shouldn't happen. First, though, find out why it did. Once she's had a chance to explain why it happened, and you have all the facts you can get, you can make an intelligent decision. Decide then whether you want to disrecommend her to any of your friends who have dogs. Take your dog somewhere else next time, if you think that's best. Do your best to resolve things peacefully and kindly.

    Lawsuits are a major pain to both parties, yourself included. It would be extremely expensive and time-consuming. Please find another way to handle it. By all means, tell your breed organization (AKC or whatever dog club you're in) about what happened.

    Talk to her first, if you havent had any problems before. Talk to the groomer first, dont get angry, she will just try to shunt you out of there if you do. Just ask how it happened, maybe it was an accident, some dogs squirm like all buggery, which can lead to accidental nicks and cuts. If you talk to her calmly, maybe she will be willing to pay vet bills and refund the grooming, just to avoid legal proceedings. But if she wont talk to you, sue the crap out of her.

    That was very wrong for the groomer to do that. To contest what happened with this groomer and to recover Vet costs and costs for injury, you'd have to go to small claims court. Since dogs are viewed as property under the law,even if your dog DIED at the groomers, the most you may get is the value of the dog plus court costs and Vet bills. If there was significant damage done, you'd want to take your Vet records and I wish you luck. Some people proceed with a case like this out of a matter of principle. What you may want to do first is to contact the groomer and tell her about your disappointment in her not acknowledging the harm to your dog and ask for a refund plus Vet costs. She may do this without having to go to court.
    It sounds awful. I hope she reimburses you and apologizes.

    Yes, I'm sure that you could sue and probably win, but suing is not always the answer. The groomer made a mistake, one that she probably doesn't make very often based on what you told us. She was an idiot not to tell you, and an even bigger idiot not to let you back in. I would TRY to talk to her, get her to pay for the vet expenses, and get her removed from the AKC list. If she refuses to pay for the vet expenses, then go the legal route, but if she is actually sorry and pays for all costs associated with the issue, let her off the hook, she just made a bad decision.

    You need to call the groomer, be persistent, even if she doesn't take your calls, leave a message on her machine. If this doesn't work send her a letter,stating she needs to talk to you. You could always mention the Better Business Bureau, or a Law suit to get her to talk to you. She should pay for your pup's vet bill, and a refund of your money for the "grooming" mess. Small businesses do not like negative publicity, you could mention that too. If she is decent about the whole deal, and seems truly sorry, you should mention that you've been happy with her work so far.If not you need to look for another groomer. Good Luck! C.H.

    I was a dog groomer for many years and could not imagine not telling an owner if I injured their pup. I would try to talk to her but if that doesn't work then you should definitly sue her for the vet bills. Tou can not get pain and suffering or anything like that but the groomer should pay all costs incurred by her injuring your dog. Make sure you get a statement from the vet stating exactly what the nature of the injury was and all costs that were incurred then take this statement to the groomer and ask that she reimbuirse you for the bills. If she refuses then sue for the money.
    I had a dog one time in my shop that was injured through no fault of mine the dog had an allerigic reaction to something it rolled in before coming to me but since it was in my shop and the heat from my dryers caused the reaction I paid all vet costs plus some.
    If you have to sue the groomer to get your money then report this to the AKC club that refferred her.

    I'd hold off on sueing for the time being..First I would call them to see when the salon owner or manager will be in..Bring in a letter from the vet stating what was wrong and what needed done, and ask for that money PLUS the money back from the grooming experience. If they are non receptive THEN I would tell them that you are contacting a lawyer and will take them to court. Most businesses hate any bad publicity and if they have any compassion for your pet, they will step up and take responsibility before things get worse..Good luck and so sorry to hear about your poor baby's bad experience.

    while your first reaction is to go claw this horrible woman's eyes out you need to remain calm. first try to negotiate with her. you need to figure out how much the vet bills are and how much time you have de to this. Figure out a total amount. I would first try calling her and explaining, then go to her store and try to speak with her. You need to document EVERYTHING. Write down everything about your phone calls or visits. If possible, record them. Make sure to mention when you speak with her that you are going to obtain a lawyer and take her to court if she refuses to settle. In the meantime you need to contact the AKC and let them know what happened. Tell your family, friends, coworker, whoever that this lady is psycho. Also try to photograph the injuries to your doggie.

    I am sorry that some greedy person had done this to you and your little pup. Make your pup feel as good as it can. Spoil her and make her feel like a queen. Good luck!

    Suing with regards to animal cases doesn't really do much. Animals are just considered property and she'd only be forced to pay you back, but allowed to continue business. Something that might help more is filing a grievance against her in her town's Business Association. The grievences filed that harder it will be for her to get business.

    Suing the groomer should be a last resort. First explain to the groomer that when she was done with your dog it required medical attention from the care they provided and that you would like to be reimbursed for the cost of the medical treatment and the cost of the visit to her service. If they decide to tell you no there are a few options to try be for actually filing a lawsuit. The first is file a complaint with the Better business Bureau, they can help you to try to reach a resolution with the groomer. If that fails visit a lawyer and have them send a letter requesting that they pay you for the cost incurred because of their negligence to avoid a lawsuit. Then you should file a warrant of debt in small claims court to get your money back. definitely contact AKC and possibly give them the vets name and contact information to verify that several animals have been injured by this place and they should take them off of their referral list. By the way how is your poor little baby? Hope that the poor little thing isn't completely traumatized by this:( Good luck !

    I agree with aimhigh and the other posters (above) – contact the BBB in your area. The groomer sounds like she has a bad reputation already and since your Vet has put up a warning sign about that groomer (!!!) you have every right to pursue this. How terrible for you dog – be sure to find a kind groomer who will help your dog to not be afraid of grooming any more (I'm sure she is now, after having been treated like that!)

    Wow, I'm sorry to hear about what happened to your dog. I would either sue them or go to some authority like the aspca and let them know what happened. That groomer should not be in business anymore. That's just plain wrong. They can't say that the dog was cut and bleeding before it came to them how stupid. I think u would have seen that. You go girl and you get them to pay for what they did to your baby.

    Sure you could sue her. And she could sue you and your vet for slander, and you for harassment for bothering her at her house and business. There are plenty of lawyers that will take on frivolous lawsuits. How will your dog benefit from that?
